These Terms of Use govern your access to and use of the RedPlus website, app, services, content, beta programme, and related digital products.

By accessing or using RedPlus, creating an account, registering for early access, joining a beta programme, downloading the app, or using any RedPlus service, you agree to these Terms. If you do not agree, you must not use RedPlus.

2. What RedPlus Provides

RedPlus is a performance technology platform designed to support controlled hypoxic training using breath-hold exposure, SpO₂ tracking, session analysis, recovery data, weekly targets, and performance-related feedback.

RedPlus may include:

  • website content

  • early access registration

  • beta testing programmes

  • mobile app access

  • user accounts

  • hypoxic session tracking

  • SpO₂ response data

  • recovery-time tracking

  • estimated RBC/HCT progress indicators

  • athlete and coach dashboards

  • educational material related to hypoxic training and performance

RedPlus is not a medical product, medical device, diagnostic tool, or substitute for professional medical advice.

3. Health and Safety

RedPlus involves controlled breath-hold hypoxia and oxygen-saturation tracking. This type of activity can carry physical risks if performed incorrectly, excessively, or by individuals with relevant health conditions.

You must read and follow the RedPlus Safety Guidelines before using the app or performing any RedPlus-related protocol.

You agree that:

  • you use RedPlus at your own risk

  • you are responsible for assessing whether hypoxic training is suitable for you

  • you should consult a physician or qualified healthcare professional before using RedPlus if you have any medical condition, cardiovascular issue, respiratory issue, neurological issue, fainting history, pregnancy, or any other health concern

  • you must not perform RedPlus sessions while driving, cycling, swimming, operating machinery, standing in unsafe locations, or in any situation where loss of control could create danger

  • RedPlus sessions should only be performed in a safe seated or lying position

  • RedPlus must not be used by children without appropriate parental/legal guardian consent and professional supervision

RedPlus content is for performance, training, and educational purposes only.

4. No Medical Advice

All RedPlus content, including app data, SpO₂ values, estimated RBC/HCT indicators, training recommendations, articles, charts, visuals, and performance feedback, is provided for informational and performance-related purposes only.

RedPlus does not provide medical advice, diagnosis, treatment, prevention, or cure of any disease or medical condition.

You must never disregard medical advice or delay seeking medical advice because of information provided by RedPlus.

If you experience dizziness, faintness, chest pain, unusual shortness of breath, confusion, prolonged low oxygen saturation, abnormal symptoms, or any other concerning reaction, stop immediately and seek medical assistance if necessary.

5. Eligibility

You must be at least 16 years old to use RedPlus unless parental or legal guardian consent is provided and use is supervised appropriately.

By using RedPlus, you confirm that:

  • the information you provide is accurate and up to date

  • you have the legal capacity to agree to these Terms

  • you will use RedPlus only in accordance with these Terms and applicable law

  • if you use RedPlus on behalf of a team, company, coach, club, or organisation, you have authority to do so.

6. Account Registration

Some features may require you to create an account.

You are responsible for:

  • keeping your login details confidential

  • all activity under your account

  • ensuring that your account information is accurate

  • notifying RedPlus if you suspect unauthorised access

  • not sharing your account with others unless explicitly allowed

RedPlus may suspend or terminate accounts if we suspect misuse, security risks, false information, or breach of these Terms.

7. Early Access and Beta Testing

RedPlus may offer early access, beta testing, trial access, or limited testing periods.

Registration for early access does not guarantee selection as an early tester.

Selected early testers may receive an extended free testing period. Users who register early but are not selected may still receive a longer free trial than users who sign up after public launch.

Beta features may be incomplete, experimental, unstable, or subject to change. You understand that beta access is provided for testing, feedback, development, and product improvement.

RedPlus may change, limit, suspend, or end beta access at any time.

8. User Data and Performance Data

RedPlus may process data that you provide or generate through your use of the website or app, including:

  • account information

  • contact information

  • training and session data

  • SpO₂ values

  • recovery-time data

  • breath-hold data

  • heart-rate data, if used

  • weekly target progress

  • estimated RBC/HCT indicators

  • coach/athlete relationship data

  • device and technical data

The processing of personal data is governed by our Privacy Policy.

You are responsible for ensuring that any data you submit is accurate and lawful.

9. Coach and Athlete Use

RedPlus may include features for coaches, athletes, performance teams, or administrators.

If you use RedPlus as a coach, team member, administrator, or organisation, you agree that:

  • you must only access athlete data where you have permission

  • you must treat athlete data confidentially

  • you must not misuse performance or health-related data

  • you are responsible for complying with applicable data protection, employment, sport, and medical rules

  • RedPlus does not replace professional coaching judgement, medical advice, or athlete monitoring obligations

10. Payments, Subscriptions, and Trials

RedPlus may offer free trials, paid subscriptions, premium features, app-store purchases, or other paid services.

If paid services are introduced, the applicable price, billing period, renewal terms, cancellation terms, and trial period will be shown before purchase.

If you purchase through Apple App Store, Google Play, or another third-party provider, billing, cancellation, and refund rules may be governed by that provider’s terms.

Unless otherwise required by law, fees already paid may be non-refundable.

11. App Stores

If you download RedPlus through Apple App Store, Google Play, or another app provider, you agree that:

  • these Terms are between you and RedPlus, not the app provider

  • the app provider is not responsible for RedPlus services

  • the app provider has no obligation to provide maintenance or support for RedPlus

  • your use of the app must also comply with the app provider’s applicable terms

12. Mobile Services and Device Requirements

To use RedPlus, you may need a compatible smartphone, operating system, internet connection, Bluetooth-enabled pulse oximeter, or other supported device.

RedPlus does not guarantee that all devices, sensors, operating systems, or third-party integrations will work at all times.

Your mobile carrier, internet provider, app store, or device manufacturer may charge fees for data, messaging, downloads, or other services.

13. Acceptable Use

You agree not to:

  • use RedPlus for unlawful purposes

  • use RedPlus in a way that creates safety risks

  • misuse hypoxic training guidance or encourage unsafe use

  • access another user’s account without permission

  • copy, scrape, reverse-engineer, or interfere with RedPlus systems

  • upload malware, spam, harmful code, or abusive content

  • use RedPlus to harass, threaten, defame, or exploit others

  • misrepresent your identity or affiliation

  • publish misleading claims about RedPlus

  • use RedPlus content commercially without permission

  • damage the reputation, operation, or security of RedPlus

  • attempt to bypass technical restrictions, payment systems, or access controls

RedPlus may suspend or terminate access if we believe these rules have been violated.

14. User Content

You may be able to submit content, feedback, images, comments, testimonials, data, or other material to RedPlus.

You remain responsible for your own content.

By submitting content to RedPlus, you confirm that:

  • you have the right to submit it

  • it does not violate third-party rights

  • it is accurate to the best of your knowledge

  • it is not unlawful, offensive, defamatory, misleading, or harmful

If you submit feedback, suggestions, ideas, or improvement proposals, RedPlus may use them without obligation to compensate you.

RedPlus will not use your name, image, testimonial, or personal story for public marketing without appropriate permission.

15. Intellectual Property

RedPlus, the RedPlus name, logo, app design, software, visuals, graphics, text, training concepts, data models, performance indicators, dashboards, content, and related materials are owned by RedPlus, NKA Invest UG, or licensed to us.

These materials may be protected by copyright, trademark, patent, trade secret, database rights, and other intellectual property laws.

You may not copy, modify, distribute, sell, license, publish, reverse-engineer, or create derivative works from RedPlus materials without prior written permission.

16. Patent and Protected Technology

Key elements of the RedPlus app concept, hypoxic-response tracking system, and related performance-data structure have been filed for patent protection.

Nothing in these Terms grants you any right, licence, or permission to use RedPlus intellectual property, patent-pending technology, methods, systems, claims, designs, data models, or proprietary concepts outside the permitted use of the RedPlus services.

17. Third-Party Services

RedPlus may integrate with or link to third-party services, platforms, sensors, app stores, payment providers, analytics tools, email tools, or coaching platforms.

RedPlus is not responsible for third-party services, content, policies, availability, accuracy, or security.

Your use of third-party services may be subject to separate terms and privacy policies.

18. Availability and Changes to the Service

RedPlus is under development and may change over time.

We may update, modify, suspend, remove, or discontinue any feature, content, service, app function, beta programme, or integration at any time.

We do not guarantee uninterrupted, error-free, or permanent availability of the website, app, or services.

19. Disclaimer of Warranties

RedPlus is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, RedPlus makes no warranties that:

  • the service will meet your expectations

  • the service will be uninterrupted or error-free

  • all data will be accurate, complete, or reliable

  • any specific performance, health, physiological, or training outcome will occur

  • any estimated RBC/HCT value will correspond to a confirmed biological measurement

  • any third-party device or sensor will provide accurate results

RedPlus does not guarantee any specific improvement in VO₂max, hemoglobin mass, red blood cells, hematocrit, endurance, recovery, fatigue resistance, race performance, or health status.

20. Limitation of Liability

To the fullest extent permitted by applicable law, RedPlus, NKA Invest UG, its officers, employees, contractors, partners, and suppliers shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of RedPlus.

This includes, but is not limited to:

  • training injuries

  • misuse of hypoxic training

  • inaccurate sensor readings

  • incorrect user input

  • loss of data

  • loss of profits

  • service interruption

  • device incompatibility

  • reliance on estimated performance indicators

  • use of RedPlus against safety guidance

Nothing in these Terms limits liability where liability cannot legally be limited, including liability for intent, gross negligence, injury to life, body, or health where applicable law does not allow limitation.

21. Indemnification

You agree to indemnify and hold RedPlus, NKA Invest UG, and its officers, employees, contractors, partners, and suppliers harmless from claims, damages, losses, liabilities, and expenses arising from:

  • your misuse of RedPlus

  • your breach of these Terms

  • your violation of applicable law

  • your violation of third-party rights

  • unsafe use of hypoxic training

  • content or data you submit

22. Termination

You may stop using RedPlus at any time.

RedPlus may suspend or terminate your access if:

  • you breach these Terms

  • you misuse the service

  • you create safety or security risks

  • you provide false information

  • payment fails for paid services

  • continued access may expose RedPlus or others to legal, technical, or reputational risk

After termination, some data may be retained as described in our Privacy Policy.

23. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we may provide notice through the website, app, email, or other reasonable means.

Your continued use of RedPlus after changes become effective means that you accept the updated Terms.

24. Consumer Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

25. Governing Law

These Terms are governed by the laws of Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
